PORCHTEMPO / TRUST & TRANSPARENCY

Terms of Service

The rules for using PorchTempo, your responsibilities for marketing content, and what to expect from the service.

Effective and last updated: October 28, 2026

1. Operator and scope

These Terms of Service govern use of the PorchTempo website and software at porchtempo.com. PorchTempo is operated by Landen Zeringue (“we,” “us”). “You” means the person using the service and, where authorized, the business they represent. If you do not agree to these terms, do not use the workspace. Our Privacy Policy explains our handling of personal information.

PorchTempo is software for planning and preparing real estate marketing. It is not a real estate brokerage, legal adviser, MLS, social network, or guarantee of advertising compliance. It is independent of TikTok, Meta, and real estate associations.

2. Eligibility and account access

You must be at least 18 and have authority to act for any business or account you represent. Use accurate account and business information. Keep your sign-in account secure and notify us if you suspect unauthorized access.

PorchTempo is currently in private testing. Workspace access requires an invitation and sign-in through ChatGPT. Public signup, paid checkout, live social publishing, and AI video generation are not open. Test features and availability may change. A published price or feature description does not mean the feature is activated or that an order has been accepted.

3. Your content and permissions

You retain the rights you hold in your photos, videos, listing facts, branding, captions, and other submitted content. You grant PorchTempo a limited, non-exclusive license to store, process, reproduce, format, and display that content as needed to provide the services you request, including use of the service providers described in the Privacy Policy. This permission does not give us a right to sell your content or use it in unrelated advertising.

You are responsible for obtaining the seller’s, brokerage’s, photographer’s, music owner’s, and any other required permissions for the intended use, including AI processing and social publishing. Do not upload content you lack authority to use. Do not include confidential client information, access codes, or sensitive documents unnecessary for marketing.

AI output may not be unique and may not qualify for intellectual-property protection. You must review it for third-party rights and accuracy before use. Rights in third-party material and platform content remain with their owners.

4. Advertising, branding, and AI review

You and your supervising broker are responsible for the accuracy, authorization, and legality of advertisements. This includes property status and price, brokerage identification, licenses and contact disclosures, fair housing and nondiscrimination rules, MLS requirements, sale-participation claims, and any required disclosure of AI-altered imagery.

Brand fields, draft checks, and recorded review acknowledgments are organizational tools. They are not legal advice, independent verification, or a certification that a post meets every applicable rule. You must obtain actual broker approval where required and keep information current.

AI room videos are interpretations of photographs, not recordings of a physical walkthrough. They may alter geometry, finishes, lighting, views, or other material details. Compare every scene with the originals, reject misleading scenes, and make required disclosures. Never represent an AI interpretation as proof of a property’s actual condition or layout.

5. Connected platforms and publishing

When available, platform connections use the platform’s own authorization flow. Connect only accounts you control or are authorized to manage. You can decline permissions or revoke access. Platform terms, privacy settings, content standards, and developer restrictions also apply.

Saving or scheduling a draft alone is not consent to publish. The planned publishing service will require you to authorize the account and approve the content, destination, and applicable publishing settings. Live publishing is not enabled in this version. PorchTempo does not promise app approval, uninterrupted platform access, a particular posting time, reach, engagement, leads, or sales.

External services can delay, reject, restrict, or remove content and change their APIs. Review platform results and keep your own copies of important content. Disconnecting stops future authorized use through PorchTempo but does not remove posts already on a social network; manage those on the destination platform.

6. Planned pricing and future billing

The planned launch prices are US$9.99 per listing video, US$49.99 per month for Social Tempo, and US$99.99 per month for Complete Tempo, which is intended to include unlimited listing photo-to-videos and social automation. These are announced plans; PorchTempo is not collecting payments or enrolling customers in recurring billing at this stage.

Before paid service begins, we will present the available features, total price, applicable taxes, billing frequency, cancellation instructions, refund terms, and any usage conditions for your agreement. Monthly subscriptions are intended to renew monthly with cancellation available before the next renewal. No purchase or automatic renewal is authorized merely by viewing these pages or entering the private testing workspace.

Any material plan or price changes will be communicated before they apply to a purchase or renewal. Rights and remedies that cannot be excluded by applicable law remain available.

7. Acceptable use

You must not use PorchTempo to:

  • Create deceptive, discriminatory, unlawful, harassing, or infringing advertisements.
  • Impersonate another person, brokerage, property owner, or platform.
  • Publish spam, manipulate engagement, or bypass social-platform review, consent, or access restrictions.
  • Access another user’s data, share credentials improperly, interfere with security, or overload the service.
  • Remove required disclosures or ownership notices, or misrepresent generated content as an actual recording.

PorchTempo’s interface, branding, and software remain ours or our licensors’, except your content and third-party materials. Use of the service does not transfer those rights.

8. Availability and responsibility

We aim to provide a useful, reliable service, but testing features may contain errors, be unavailable, or change. Keep independent copies of original property photos and important campaign information. Do not rely on PorchTempo for emergency communications or time-critical legal notices.

To the extent permitted by applicable law, the service is provided “as is” and “as available,” without warranties of uninterrupted operation, error-free output, fitness for a particular purpose, or a specific business result. We do not exclude warranties or liabilities that cannot lawfully be excluded.

To the extent permitted by law, we are not responsible for indirect or consequential losses, lost opportunities, or losses caused by third-party outages or content decisions outside our control. Nothing here limits liability for fraud, willful misconduct, or other liability that applicable law does not allow us to limit.

9. Ending access and deleting information

You may stop using PorchTempo, disconnect social accounts, or request account deletion at any time. Follow our data-deletion instructions. Deletion may require verification and does not remove exported copies or content already published to an external platform.

We may restrict or suspend access when reasonably needed to address misuse, security threats, legal requirements, or platform restrictions. Where appropriate and feasible, we will provide notice and a way to contact us about the decision. We may discontinue testing features or the service; we will provide reasonable notice where practicable and meet any obligations that apply to paid services if introduced.

Terms that reasonably need to continue after access ends—such as ownership, responsibility for prior content, lawful retention, and limits permitted by law—continue to apply.

10. Updates and contact

We may revise these terms as the service evolves. We will update the date, provide notice of material changes where required, and obtain any legally required agreement before those changes apply. These terms do not remove mandatory protections available under applicable law.

For service questions, complaints, or a dispute, contact our support email so we can try to resolve the issue. The operator is Landen Zeringue. Contact details are also available on the contact page.
